Underwater Festival 2011 details released

Details and a promotional video has been released about the Underwater Festival 2011. Taking place between 2-11 September 2011, the Festival plans to incorporate 100 events during the 10 days, as well as a still and video shootout that will happen over all of Australasia* during the Festival dates.

The top 100 images will be showcased at the new Australian Dive & Tavel Expo ODEX in Brisbane on the first weekend in October 2011 and there are many prizes available.

*Australasia is defined by the organizers as:

Australia, Brunei, Cambodia, Cook Islands, East Timor, Fiji, French Polynesia, Indonesia, Malaysia, Maldives, Federated States of Micronesia, Myanmar, New Caledonia, New Zealand, Niue, Palau, Papua New Guinea, Philippines, Samoa, Singapore, Solomon Islands, Thailand, Tonga, Vanuatu and Vietnam.

I don’t like the conditions that they put on the photos, They are basically saying that they can use your image for whatever they like till the end of time. Below is a bit of example of my interpretation of the rules posted on the website. • Competition organizers reserve the right to make use of images and videos submitted to the competition for the purpose of publishing a competition album, calendars, DVDs and any other use that promotes future competitions or found useful by the Underwater Festival organisers. • Submitted photos and video shall indefinitely remain in the producers' archives without the requirement of further permission for usage. Naturally, the copyright of the submitted photos and videos remains with the author. They are forgetting “Moral Rights” which means that they have to acknowledge the person who has taken the image which they referring to below but saying that they don’t have because it mightn’t be possible. Which is silly because they have every ones details when you enter, they are covering themselves if they stuff up their own database. • Submitted photos and video entries might be selected for inclusion on the underwater australasia photo and video galleries (http://www.underwater.com.au) and associated websites all with acknowledgement of the authors of course wherever possible. • Photos and videos will not be sold without the permission of the author. Ok they are saying that they won’t sell the images or video individually but it can be done in books etc forever. This statement contradicts one of the other rules noted above which they states “or found useful by the Underwater Festival organisers”. • Photo and video credits will be given to the author/artist when applicable. • Submission of photos and participation in the competition entails an automatic acceptance of all rules & regulations above. Use of images or video as described above will require no additional written or verbal permissions from the photographer, artist or videographer. Once they have got your image they don’t have to do anything to notify you. regards Matti
